This was such a crock in March/April 2020. The lines were clearly butt fucked. In retrospective, mostly by typical over-reactions from local authorities to SARS infections who unnecessarily wouldn't let cruise ships with sick passengers port. The immensity of that cluster doesn't get a lot of press. It was also a long time ago. Then teh CDC got involved and succumbing to the hysteria ordered the cruise industry shut down.

The good news is that Rod Desantis sued HHS/CDC over the shut down of the cruise industry as an after effect of of these fuck-ups by local communities who told ships to go away. Complete dumbfuckery on both counts. So far, as I've reported, FL has prevailed on HHS's/CDC's appeal of the Middle Court of FL's ruling granting a preliminary injunction of the directive put out by the CDC - a complex, mumbo-jumbo set of rules (first the No-Sail Order or NSO and then Conditional Sailing Order or CSO to restart cruise ship operations) the cruise line has been forced, until now (the CSO become unenforceable on July 18th) to follow. No more. Interestingly, the curise industry having invested a lot of money following the CSO are sticking with most of it. "Voluntarily" and that's another story.

The original civil suit will be litigated in the same court that ruled in favor of FL, granting a preliminary injunction, and telling the CDC that their shut down of the cruise industry over a year ago was illegal. That happens beginning the 12th of this month. Most legal experts think that FL will prevail confirming the illegality of CDC actions involving the cruise lines. The FL case is narrowly focused on damages created by a portion of maritime law that the CDC claims authorized them to deny entry/operation of cruise ships to US ports (free pratique) on the basis of these ship's potential to spread infectious disease.

Judge Merryday issued a stinging rebuke of HHS/CDC overreach in wrongly interpreting the enforcement authority that Congress authorized. Some of his best lines found in his 124 page ruling are his warnings about the administrative state and un-elected administratively appointed officials making laws being accountable to no one. Sound familiar? If so, you'll appreciate the far reaching effect a FL v. Bacerra & Walenski win will have in this case on governments imposing the kinds of mobility and social restrictions we've been dealing with over the last 17 months.
